This is true to a certain extent, but in this (and most situations) it is extremely hard to defend a trademark that has not been registered. Read through that entire Wikipedia article if you want to know more...It touches on that issue quite a bit, more than just the little bit that you quoted

In this case, I'd say that it would almost be impossible for IFSkinZone, as they haven't done any "business" with their slogan to my knowledge. As far as I can tell, all they've done is displayed it on their website.

How so? Copyrights are used for "intellectual property" which tends to be artwork, written content, etc...not names and slogans. A few words doesn't cut it to prove 'copyrightable' material.

I meant TM not copyright...too much typing today with all those postfusion sites I joined up.
